What is International Mediation?
International mediation is a rapid and confidential tool for resolving civil and commercial disputes involving parties, contracts, or interests located in different countries, or governed by supranational law (EU law, international conventions). Through international mediation, businesses, professionals, and individuals avoid lengthy negotiations abroad, reaching a negotiated agreement that takes into account languages, jurisdictions, and applicable laws.
Introduction
International mediation is a rapid and confidential means of resolving civil and commercial disputes involving parties, contracts, or interests located in different countries or governed by supranational laws, such as European Union law and international conventions. Through this process, businesses, professionals, and individuals avoid lengthy proceedings before foreign courts by reaching a negotiated agreement that takes into account applicable languages, jurisdictions, and laws, in line with the principles of civil and commercial mediation governed by Legislative Decree 28/2010 and Ministerial Decree 150/2023.
What is International Mediation?
International mediation is a voluntary or judge-mandated procedure in which an impartial third party, the mediator, helps the parties find a shared solution to disputes involving international elements, such as residence in different countries, the choice of a foreign law, or the existence of assets or legal relationships with relevance in multiple jurisdictions.
This is an advanced form of civil and commercial mediation that integrates the national regulatory framework with European Union law, multilateral conventions, and any competent foreign courts, offering a more flexible tool than litigation. This procedure allows the agreement to be tailored to the specific needs of the parties, avoiding the rigidities typical of cross-border proceedings and promoting the continuity of business relationships. Specifically, it allows issues of jurisdiction, applicable law, and recognition of agreements to be addressed with a practical approach, coordinated with the parties' lawyers.
When International Mediation is Useful
International mediation is particularly suitable when the dispute concerns:
- Cross-border commercial contracts: supplies, distribution, agency, franchising, international e-commerce between companies with headquarters in different countries
- Professional services: services or consultancy received from foreign entities, including technical and IT services and specialist assistance at an international level
- Contractual or non-contractual liability: with elements of private international or European Union law, including issues of non-performance, compensation for damages and guarantees
- Intellectual property: use of trademarks, licenses, copyrights, patents and other legal situations with effects in multiple jurisdictions
In all these cases, mediation allows for overcoming the challenges of jurisdiction, applicable law, and the costs of litigation before foreign courts, while maintaining control over the outcome. The parties can define the terms, modalities, and content of the agreement, preserving business relationships and their reputation in the international marketplace.
Who is it for?
International mediation for lawyers and law firms allows us to offer clients an effective solution to disputes with foreign counterparties, maintaining strategic control of the case and enhancing the role of counsel. The procedure is also designed for companies and professionals working across borders who desire international corporate mediation services coordinated by an accredited organization based in Palermo.
International Mediation for Lawyers and Law Firms
International mediation offers lawyers and law firms the opportunity to offer clients an effective solution to disputes with foreign counterparties, without sacrificing procedural strategy and the legal framework of the case.
The lawyer supports his client throughout the entire process, helping to evaluate jurisdiction, applicable law, contractual clauses, and any coordination with pending proceedings in Italy or abroad.
For firms assisting exporting companies, digital commerce operators, multinational groups, or foreign investors, international mediation represents a risk management and economic interest protection tool that can be integrated with arbitration and litigation.
Concordia et Ius structures the process to enhance the role of the lawyer, both in person in Palermo and via online connections, ensuring operational support and coordination with the Secretariat for all procedural and administrative aspects.
International mediation for businesses and professionals
Businesses operating across borders can use international mediation to quickly resolve disputes with foreign suppliers, distributors, agents, online platforms, or customers, avoiding operational bottlenecks and unpredictable costs.
It is particularly useful for:
- SMEs and exporting companies that want to maintain strategic commercial relationships in foreign markets
- Technology and e-commerce startups with international clients and partners
- Professionals and consultants with international clients, such as technical studios, consulting firms, or creative sector companies
