DELEGATED MEDIATION
Operating in compliance with current legislation, the Legislature has pursued two objectives of socio-legal importance: on the one hand, streamlining the procedural burden through an effective litigation-deflation tool; on the other, promoting "pacification" between the parties, preventing the conflict, if prolonged, from degenerating into exasperated opposition.
In this context, civil mediation, if conducted by a qualified, legally recognized organization staffed by appropriately trained professionals, plays a strategic role in civil proceedings. It serves as a complementary tool for the Magistrate, who, with a view to procedural economy, may order mediation when he or she believes the conflict can be resolved in a more flexible setting, free from rigid procedural formalities. In this way, the Judge becomes a true "peacemaker," using mediation as an auxiliary tool to the jurisdiction.
Concordia et Ius Srl, the Conciliation Body, actively operates throughout the country, employing a team of highly qualified and experienced mediators, duly accredited by the Ministry of Justice. The Body also collaborates with specialized lawyers, certified to act as professional conciliators.
The Organization intends to be the body responsible for managing conciliation attempts through delegated mediation, when ordered by the Judge. Accordingly, it undertakes to accept and manage all assignments assigned by the Lawyers and the Parties, in accordance with its own Regulations, already approved by the Ministry of Justice, and with the support of its specialized administrative staff.
