Delegated Mediation

Operating in this regulatory logic, the Legislator intended to pursue two different purposes, both assuming a socio-legal value of considerable importance, the first being aimed at streamlining the process through the adoption of a simple deflationary tool for litigation and, at the same time, aimed at the "pacification" of the Parties outside the ambit of a dispute which, if protracted, inevitably tends to exacerbate the conflict.

Therefore it can peacefully be asserted that the civil mediation procedure, carried out by a highly qualified, legally recognized, logistically equipped with suitably trained professionals, can assume great importance in civil proceedings, configuring itself as a valid tool for the Magistrate who, recognizing the possibility and /or the opportunity, considers the conflict to be settled in a venue free from rigid procedural ties and, operating in a procedural economy perspective, proposes itself as a "peacemaker" through the use of an "auxiliary" body.

 

The Concordia et Ius srl Conciliation Body actively operates in the area with the use of a professional force of high quality and experienced Mediators, adequately trained and regularly accredited by the Ministry, and makes use of the work of expert Lawyers, qualified such as Professional conciliators, and proposes itself as a Body delegated to manage conciliation attempts through delegated Mediation, which is ordered by the Judges and undertakes to accept all the assignments that will be conferred on it by the Lawyers and/or by the Parties who deem to make use of the Organism, following the delegated mediation arranged by the Judge and to manage them on the basis of its own Regulations, already approved by the Ministry of Justice, with the use of its own administrative staff.
