Telematic Mediation

Mediation can take place according to the electronic methods provided for by the Body's Regulations, in compliance with art. 8-bis of Legislative Decree 4 March 2010, no. 28.

This service is available and accessible to anyone with a computer with internet connection and a webcam; allows the requesting Parties and Invited Parties and/or their lawyers and representatives to follow the entire Mediation procedure by videoconference, directly from their own office or studio, without having to physically go to the offices of the Mediation Body.

The telematic mediation service represents a method of an integrative and complementary type to the classic mediation service which normally takes place in the presence of the parties. The online Mediation procedure is activated by sending the Mediation application in electronic or paper format, duly completed, dated and signed.

The Concordia et Ius srl conciliation body uses a restricted access platform with security protocols whose standard is defined by the https secure communication protocol. The service is accessible after registration, to be carried out by following the instructions on the official website of the Concordia et Ius srl Conciliation Body. Following registration, the user is assigned a personal and confidential username and password, to be used for access to the service and carrying out of Mediation, on the day and at the established time.

The conciliation attempt takes place in a reserved proprietary area which can only be accessed by the Parties, their lawyers, the Mediator and the service manager, after assigning a confidential and personal password, which is communicated to them directly by the secretariat via e- mail and remains valid only for that particular procedure. Therefore, the access credentials, personal and secret, are provided to the Parties and to the Mediator by e-mail or PEC, and allow access, only in relation to the Mediation in progress, on the day and at the pre-established time for each individual session . For each individual Mediation the above credentials will be renewed at each Mediation session.

The dialogue and discussion between the Parties in Mediation, with the presence of the Mediator, take place within an audio/video web conference system also equipped with a chat room, through which it is possible to highlight one's requests, evaluate mutual positions , and try to reach, through discussions, a satisfactory solution for all concerned.

The Parties also have the possibility of speaking separately with the Ombudsman in complete confidentiality, and of transmitting to the latter all the documentation that they wish not to be disclosed to the other party.

When Mediation takes place electronically, each document of the procedure is formed and signed in compliance with the provisions of the Digital Administration Code, referred to in Legislative Decree 7 March 2005, n. 82, and can be sent by PEC or other qualified certified delivery service.
