Telematic Mediation
Mediation may be carried out using the electronic methods provided for by the Regulations of the Organization, in compliance with art. 8-bis of Legislative Decree 4 March 2010, n. 28.
This service is available and accessible to anyone with a computer with an internet connection and a webcam; it allows the requesting Parties and the invited Parties and/or their lawyers and representatives to follow the entire Mediation procedure via videoconference, directly from their own office or study, without having to physically go to the offices of the Mediation Body.
The telematic Mediation service represents an integrative and complementary modality of the classic Mediation service that normally occurs in the presence of the Parties. The telematic Mediation procedure is activated by sending the Mediation request in electronic or paper format, duly completed, dated and signed.
The Conciliation Body Concordia et Ius srl uses a restricted access platform with security protocols whose standard is defined by the protocol for secure communication https. The service is accessible after registration, to be carried out by following the instructions on the official website of the Conciliation Body Concordia et Ius srl. Following registration, the user is assigned a personal and confidential username and password, to be used to access the service and carry out the Mediation, on the day and at the time established.
The conciliation attempt takes place in a reserved proprietary area that can only be accessed by the Parties, their Lawyers, the Mediator and the person responsible for the service, after assigning a confidential and personal password, which is communicated to them directly by the secretariat via e-mail and remains valid only for that specific procedure. Therefore, the access credentials, personal and secret, are provided to the Parties and the Mediator via e-mail or PEC, and allow access, in relation to the Mediation in progress only, on the day and at the time established for each individual session. For each individual Mediation, the above credentials will be renewed at each Mediation session.
The dialogue and discussion between the Parties in Mediation, with the presence of the Mediator, take place within an audio/video web conference system also equipped with a chat room, through which they can highlight their requests, evaluate each other's positions, and try to reach, through discussion, a satisfactory solution for all interested parties.
The Parties also have the possibility to speak separately with the Mediator in complete confidentiality, and to send to the latter all the documentation that they do not wish to be disclosed to the other party.
When Mediation is carried out electronically, each document of the procedure is drawn up and signed in compliance with the provisions of the Digital Administration Code, pursuant to Legislative Decree 7 March 2005, no. 82, and can be transmitted via PEC or another qualified certified delivery service.
